A guardianship is a legal arrangement where a court appoints a person (the “guardian”) to make decisions on behalf of another individual (the “protected person”) who is deemed incapacitated or incapable of making their own decisions. This incapacitation can be due to a physical or mental condition, or in the case of a minor, their age.
At Harrell Law LLC, we can help you be appointed as Guardian over the Person, Guardian over the Estate, or both Guardian of the Person and Estate of an Incapacitated Adult or a Minor Child. A "guardian over the person" is responsible for the person's care and wellbeing, while a "guardian over the estate" is responsible for asset and financial management.
At Harrell Law LLC, we can help you be appointed as Guardian over the Person, Guardian over the Estate, or both Guardian of the Person and Estate of an Incapacitated Adult or a Minor Child. Sample instructions for both are available to download below.
Indiana is developing a online guardianship registry. The registry provides useful and timely information to the public on the current status of guardianships throughout the state. It serves as a vital tool for hospitals, banks, law enforcement, mental health facilities, government agencies and other service providers.
The registry helps in critical situations where these providers need to know if someone is under a guardianship and who needs to be contacted. The Guardianship Registry Information Sheet is available below to download.

Elder law deals with the issues faced by the fastest growing segment of the U.S. population, the elderly. Seniors today are more active and live longer than ever before, which means they face a variety of new issues not addressed by earlier generations.
Now that seniors are living longer, there are more issues about their care that have to be included in estate planning, such as plans for housing, future medical care, and what to do if the person is in need of care and has become incapable of making their own decisions.
My goal is to ensure that you or your loved one receives the best care possible, addressing all legal and financial concerns. I work together with clients to develop a plan that will appoint people to act on your behalf if you are unable to make your own decisions, provide quick and easy distributions of assets, and provide you peace of mind knowing that you have protected yourself and your loved ones.
Please Note: We do not file Medicaid applications in-house, but can refer you regarding VA and Medicaid benefits.
